I think there’s an obvious reason why this memo is being issued right now. That leads me to believe it’s likely the Department of Education will not hold this belief soon so I wouldn’t view this as super significant.
Would this impact the Red Brick Legacy or just money that schools spend on their own?
To me, this reads like it wouldn’t effect 3rd party NIL, just the revenue share directly from schools
I think MooreHawk is mistaken. Title nine requirements have been applied fairly consistently regardless of the occupants of the executive office.
The interesting thing is that the payments are not being characterized as wages. That would have, perhaps, more far reaching effects.
The Title IX policy for athletics has remained unchanged since it was adoped in 1979. Federal enforcement has also remained unchanged since then in that it is nearly zero. The vast majority of Title IX violation cases are brought by individuals or teams to the Department of Education’s Office for Civil Rights and even then when schools are found to be non-compliant there is little to no follow up to ensure that the agreed upon resolution is completed.
So really the only option for change is to do something, not to reduce what they do.
Certainly no one has tried to say that schools don’t need female teams or anything like that, but Title IX interpretations have varied significantly under recent administrations in certain areas beyond just athletics. I’d view this as similar hence the rush to get it out the door.
